The Intellectual Property Alternative Dispute Resolution Center offers parties a paradigm change as an alternative to the conventional ADR processes that traditionally have been used. The paradigm change is premised on decades of experience by legal and technical professionals handling intellectual property matters. The Center's fundamental principles are applicable to all ADR processes related to IP matters, from litigation to licensing to contract disputes.

The Paradigm Change

Conventional ADR resources, such as JAMS or AAA, generally have arbitrators or mediators from whom the participants may choose. The list of available professionals is often populated with retired judges or other professionals who have experience with cases across broad subject matter. Such organizations are rightfully esteemed and effective in many cases; however, we believe IP matters, particularly those regarding technology, require a different level of expertise. Although these organizations remain important for many cases, the Center provides an alternative methodology for resolving IP matters.

Most disputes today involve court-ordered or otherwise agreed upon ADR. Whether arbitration or mediation, the goal of the dispute resolution process is the same. In every scenario, the cost to the parties can be substantial. Based on real-world experience, particularly in technology-related cases, the cost is attributable to several factors. Of those, perhaps the most significant factor is the increased time, and therefore cost, required to develop a relevant understanding of the underlying technology. 

The Center changes the paradigm by going in reverse. The Center identifies independent potential candidates who have the pertinent qualifications based on unique intake procedures. These procedures identify specific details, including and importantly the relevant technology, as well as other germane factors. This ensures the parties have a highly qualified individual with a solid foundation and little, if any, learning curve. This will reduce the time required to resolve the matter and therefore significantly reduce cost.

Infusion of Latest Technology

Another relevant factor in the increased cost of the ADR process are the inefficiencies resulting from failing to utilize innovative technology. To that end, the Center employs proprietary Artificial Intelligence technology that can reduce costs by orders of magnitude. As an example, the Center's technology can provide attorneys and parties with the ability to dissect video testimony in a number of ways, including facial gesture recognition, object recognition, Natural Language Processing, and other customizable criteria. The IPADR Center also identifies and ensures that the parties are aware of the latest technology and strongly encourages them to do so, from legal-based software to back-end hosting and security.
